Copyright and Counter-Notice

Sebairo removes infringing content when a rights holder tells it about it properly. This page explains what “properly” means, and what the person on the other end can do about it.

1. Which law applies

Sebairo is operated from the United Kingdom, and the primary framework is UK copyright law and the notice-and-takedown practice that goes with it. Sebairo has not designated an agent with the United States Copyright Office and does not hold a US safe-harbour registration.

Notices in the familiar DMCA form are welcome and are handled through the same process described here — the form is a useful checklist regardless of jurisdiction, and it contains everything needed to act. Naming the process after the American statute is convention; the substance below is what matters.

2. Before you send a notice

A notice is a legal statement, and sending one carelessly has consequences. Three checks first:

  1. Is it actually your work? Owning a copy is not owning the copyright. Commissioning something does not always transfer it. If you are acting for someone else, you must be authorised to act.
  2. Is there a defence? Quotation, criticism, review, news reporting, parody and pastiche can all be lawful uses of someone else's work. A short excerpt with attribution in a review is usually not infringement.
  3. Would a message solve it faster? Many cases are someone who did not know, and who will take it down if asked. A notice is available either way, but the message often takes an hour and the process takes longer.

3. Sending a notice

Send the notice by email to support@sebairo.com with [Copyright] in the subject line. It must include all of the following, or it cannot be acted on:

  1. Your full legal name, postal address, email address and telephone number.
  2. Identification of the copyrighted work you say has been infringed. Where several works are covered by one notice, a representative list.
  3. Identification of the material on Sebairo you want removed, precise enough for it to be found: a direct link to the post, listing, page or profile, and where relevant a description of which part of it.
  4. A statement that you have a good-faith belief that the use is not authorised by you, your agent, or the law.
  5. A statement that the information in the notice is accurate, and that you are the copyright owner or authorised to act on their behalf. Where you make this statement under penalty of perjury in the US form, say so.
  6. Your physical or electronic signature.
Be careful

Your notice, including your name and contact details, will normally be passed to the person whose content is affected so that they can respond. That is how a fair counter-notice process works. Do not send a notice if you are not prepared for the other side to know who sent it.

4. What happens next

  1. The notice is checked for completeness. An incomplete notice is returned with a note about what is missing rather than silently ignored.
  2. Where the notice is complete and the claim is not obviously unfounded, the material is removed or restricted.
  3. The person who posted it is told what was removed, why, and that they may file a counter-notice.
  4. The action, the notice and the outcome are recorded in the moderation audit log.

Sebairo does not judge disputed questions of ownership or fair dealing. Where both sides make a substantive case, the material stays down and the parties are told the matter is between them — a platform is not a court.

5. If your content was removed

If your content was removed and you believe the claim is wrong — you own the work, you have a licence, or the use was lawful — you can file a counter-notice.

Send it to support@sebairo.com with [Copyright — Counter-Notice] in the subject, including:

  1. Your full legal name, postal address, email address and telephone number.
  2. Identification of the material that was removed, and where it appeared before removal.
  3. A statement that you have a good-faith belief the material was removed as a result of mistake or misidentification, and why — “I took this photograph myself” is a reason; “I disagree” is not.
  4. A statement that you consent to the jurisdiction of the courts of England and Wales, and will accept service of process from the person who sent the original notice.
  5. Your physical or electronic signature.

The counter-notice, including your contact details, is passed to the original complainant. Where the complainant does not begin legal proceedings within a reasonable period, the material may be restored.

6. Repeat infringement

Accounts that repeatedly post infringing material have their accounts terminated. Complaints that were withdrawn, successfully answered by counter-notice, or found to be unfounded do not count towards that.

7. Trademark, impersonation and other rights

This page is about copyright. Other complaints go through the ordinary reporting route in the app, which reaches the same moderation queue:

  • Trademark — a business page, listing or ad using your mark to mislead. Report it and include your registration number and the goods or services it covers.
  • Impersonation — someone pretending to be you or your business. Report the profile and include a link to your own, so a reviewer can compare the two in seconds.
  • Privacy — your personal information published without consent. Report it and say what the information is; see also section 12 of the Privacy Policy.
  • Counterfeit goods — report the listing; this is also a breach of the Acceptable Use Policy.

8. Misusing this process

Knowingly sending a false notice — to remove a competitor's listing, to suppress a review, or to win an argument — is a misrepresentation, may make you liable for damages, and is a breach of the Acceptable Use Policy. Repeated bad-faith notices are ignored and the sender's own account is actioned.
